The Arbitration Process. 

If you are unable to settle your case with the insurance company, you may be able to demand arbitration rather than proceed with litigation. Most insurance policies  have a provision allowing for the demand of arbitration - usually under the auspices of the American Arbitration Association rules. The process usually begins with you and your insurer selecting an arbitrator to hear the details of the case - your arbitrator is usually referred to the claimant (or plaintiff's) arbitrator. While you can select your own arbitrator, the other side has some input. Unless you select a highly-qualified and experienced arbitrator, agreeing on an arbitrator often involves a fair amount of negotiation between you and your insurer. Your arbitrator and the insurance company's arbitrator will meet and appoint a lead arbitrator- who will set the arbitration schedule and act as the referee/judge. Under the AAA rules, all arbitrators are to professionals with extensive knowledge and experience to be able to assess and determine a fair and reasonable amount of compensation.   Mr. Mannis has been appointed and served as arbitrator on average of 33 cases per year and has been consulted on many more cases by other personal injury  and car accident  lawyers. 

Once the arbitrators have been selected, the lead arbitrator will set a date for a "hearing" - usually this is more of a deadline for both sides to submit all the documents backing their arguments. By design, arbitration builds in this moment for both sides to cool off, review the other side's arguments and determine how they wish to proceed. It is at this point that nearly two-thirds of all cases are settled or withdrawn - having seen the other side's arguments and evidence, one party determines it is better off settling. If there is not a settlement, the lead arbitrator will schedule a meeting for all of the parties to discuss the matter with the lead arbitrator.   Before issuing an awards ruling, the lead arbitrator may ask for another round of written counterarguments. When the lead arbitrator finally issues an awards statement, it is likely to be brief, but under most insurance policies, it is binding.  Therefore, it is critical to have an arbitrator who has the experience and knowledge to advocate for your claim and maximize your possible recovery.
